Article 1: Parties and Definitions

• Site: The website consisting of the domain name www.turkeycamper.com and its affiliated subdomains.

• User/Member: Any natural or legal person who accesses the Site, benefits from the services on the Site, or becomes a member to do so.

• Service: The entirety of camper rental, tour packages, consultancy, and other related services offered by TurkeyCamper via the Site.

• Agreement: This Terms and Conditions & Membership Agreement.

Article 2: Subject and Acceptance of the Agreement

This Agreement governs the User's use of the Site, the conditions for benefiting from the Services offered, and the rights and obligations of the parties. The User is deemed to have accepted all provisions of this Agreement from the moment they begin to use the Site. This Agreement, along with the Privacy Policy and the Clarification Text on the Protection of Personal Data, which are its integral parts, constitutes a whole.

Article 3: Use of Services and User's Obligations

3.1. The User warrants that they are at least 18 years of age and have the legal capacity to enter into binding contracts.

3.2. The User agrees to use the Site only for lawful purposes and in a manner that does not infringe upon the rights of, restrict, or inhibit the use and enjoyment of others.

3.3. The User represents and warrants that all information provided during registration or reservation processes (such as name, surname, email, phone number, T.C. identity number, etc.) is accurate, complete, and current. The User is solely responsible for any damages arising from incorrect or incomplete information.

3.4. The User is responsible for the security of their username and password, if any. The Company cannot be held responsible for any damages arising from the unauthorized use of account information.

Article 4: Reservation, Payment, and Cancellation Policies

4.1. Reservations made for services offered on the Site (e.g., camper rental) are confirmed upon the payment of the prepayment or full amount determined by the Company.

4.2. Payment terms, cancellation, and refund policies may be specified separately for each service or campaign. The User agrees to have read and approved the preliminary information form and the distance sales contract presented to them during the reservation process.

4.3. Cancellation and refund procedures are subject to the provisions of the Law on the Protection of the Consumer and the Regulation on Distance Contracts, as well as the cancellation policy determined by the Company and presented to the User at the time of reservation.

Article 5: Intellectual Property Rights

5.1. The ownership and intellectual property rights of all text, graphics, logos, images, software, designs, brands, and all other content ("Content") on the Site belong to TurkeyCamper or its licensors and are protected by Turkish and international copyright laws.

5.2. The User may not reproduce, distribute, copy, publicly display, or create derivative works from any part of the Content without the express written consent of the Company.

Article 6: User-Generated Content

6.1. The User may submit reviews, comments, or other content to the Site. The submitted content must not be illegal, obscene, threatening, defamatory, libelous, or infringing on intellectual property rights.

6.2. The User warrants that they own all rights to the content they submit or are authorized to use such rights. By submitting content, the User grants TurkeyCamper a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, publish, and display such content.

Article 7: Limitation of Liability and Disclaimer of Warranties

7.1. This Site and its content are provided on an "as is" and "as available" basis. TurkeyCamper does not warrant that the Site will operate uninterrupted or error-free, nor does it guarantee the accuracy, reliability, or currency of the content.

7.2. To the fullest extent permitted by law, TurkeyCamper shall not be liable for any damages of any kind, including but not limited to direct, indirect, incidental, punitive, and consequential damages, arising from the use of or inability to use the Site.

7.3. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis.

The Site may contain links to third-party websites that are not owned or controlled by TurkeyCamper. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that you are solely responsible for any damage or loss caused by or in connection with the use of such sites.

Article 9: Protection of Personal Data

TurkeyCamper respects the privacy of its Users' personal data and acts in accordance with the Personal Data Protection Law No. 6698 ("KVKK"). For detailed information on how your personal data is collected, processed, stored, and your rights, please review the "Privacy Policy" and "KVKK Clarification Text" available on the Site.

Article 10: Force Majeure

Neither party shall be held liable for failure to perform its obligations under this Agreement due to unforeseen and unavoidable events beyond their control, such as natural disasters, war, acts of terrorism, pandemics, legislative changes, general strikes, etc. ("Force Majeure"). During a Force Majeure event, the obligations of the parties shall be suspended.

Article 11: Modification of the Agreement

TurkeyCamper reserves the right to unilaterally modify this Agreement at any time. Any changes will become effective on the date they are posted on this page. Your continued use of the Site after such changes have been posted constitutes your acceptance of the new terms. It is the User's responsibility to review this page periodically to stay informed of any updates.

Article 12: Termination of the Agreement

In the event that the User breaches any provision of this Agreement, TurkeyCamper may suspend or terminate the User's access to the Site or their membership immediately, without prior notice.

Article 13: Governing Law and Jurisdiction

13.1. The laws of the Republic of Turkey shall apply to the interpretation and enforcement of this Agreement.

13.2. The Muğla (Marmaris) Courts and Execution Offices shall have exclusive jurisdiction in resolving any disputes arising from this Agreement.

Article 14: Miscellaneous Provisions

14.1. Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement.

14.2. No Waiver: The failure or delay of the Company to exercise any right arising from this Agreement shall not be construed as a waiver of such right.
